Privacy Policy

1. Basic Information

We process the following Personal Data about you:

• Name and surname, contact details (especially email, phone number), address;
• Billing information and bank details (data necessary for accounting);
• Information you provide in communication with us (especially your questions and responses to your inquiries, communication with you).

We do not process Special Categories of Personal Data.

2. For what purpose do we process personal data and what is the reason for processing

2.1 Fulfillment of contractual relationship and related legal obligations.

The reason for processing Personal Data is fulfilling a purchase contract and related obligations (delivery of goods, accounting, handling complaints, or if you exercise the right to return goods within the statutory period). We will process your name and surname, contact details (home and delivery address, email, and phone number), and possibly other billing information. Personal Data is processed for the duration of the contractual relationship and subsequently for 4 years after its termination (we have an interest in keeping certain Personal Data related to the purchase contract to protect our interests). We are legally obliged to archive accounting and tax documents. The retention period for these data can be up to 10 years from the end of the tax period in which the performance occurred. If necessary for delivery and payment purposes, the Personal Data collected by us will be passed on to the authorized transportation company or the authorized credit institution.

2.2 Card Payment.

If you provide us with your card payment information, we do not have access to complete card data. We only know that you are paying by card, and the card information is processed by the recipients of this data who process the payment for us.

2.3 Order Processing.

To fulfill your order, we also cooperate with other service providers (carriers and others) who help us fulfill concluded contracts. We pass your data to these partners solely to fulfill the obligations of the purchase contract.

2.4 Communication with Customer Support, Complaints, or Other Inquiries.

If you have contacted us, your Personal Data is processed based on your consent for the purpose of handling an inquiry or complaint. We may process the following Personal Data about you: name, surname, phone number, email, order details. Completed inquiries and complaints from customer support are regularly deleted, but no later than 4 years after the inquiry or complaint is resolved.

2.5 Reviews.

Customer evaluations are important to us. We will publish reviews if you give us consent to do so (by providing a review for a particular product or service). We may process the following Personal Data about you: name, surname, email, order details. With your explicit consent, we will also process photographs and Personal Data included in the review text. Reviews are submitted for the duration of your consent, but no later than 5 years.

2.6 Customer Evaluation.

You can share your shopping experience and evaluate individual products. To assess your feedback regarding individually purchased goods, we may employ other Processors.

2.7 Legal Obligations.

We may transfer Personal Data to other third parties if required by law or in response to legal requests from public authorities or upon court request in legal disputes.

2.8 Age Limitation.

For goods subject to age restrictions, we verify that you have reached the required minimum age in accordance with applicable legal regulations. For this purpose, we use an identification service that allows us to verify your age.

2.9 Digital Products.

For necessary updates of goods with digital components or digital products, we process the information you provided when ordering.

3. Communication

3.1 Emails We May Send.

In the context of selling our goods or services, we may send emails to customers concerning:

• Delivery notices, delivery date updates
• Tax documents, invoices
• Provision of a return label for goods.

4. Processors

Your Personal Data may be passed on to our business partners (Processors) or other third parties if required by law. We only use verified Processors with whom we have a written contract, and who provide at least the same guarantees as we do to you. We only work with Processors who are from the European Union, or from countries deemed recognized as safe, or from countries with whom we have standard contractual clauses in accordance with Article 46 of the GDPR and who provide a similar level of protection for your Personal Data as provided by the GDPR and Czech legal regulations. All our Processors are bound by confidentiality obligations and may not use the provided Personal Data for any purposes other than those for which we have disclosed them in accordance with these principles.

5. What Rights Do You Have?

Where to Contact Us? Write to us at the email address contact@elektrikshop.ro, or at our registered office address.

When Will We Respond? We will reply no later than one month. If providing information might jeopardize the privacy of other persons, or if the provision would pose unreasonable risks or costs, we may not be able to accommodate your request. In the case of a repeated request, the Administrator may charge a reasonable fee for a copy of Personal Data.

• Right of Access. Confirmation of whether we process your Personal Data. Information on processing purposes, categories of Personal Data, recipients to whom they are disclosed, processing time, the existence of the right to request any of the rights listed below from the Administrator. The condition is that the rights and freedoms of other persons are not adversely affected.
• Right to Rectification. Request correction of inaccurate Personal Data.
• Right to Erasure. If no other reason exists to continue processing these data, we will delete or fully anonymize the data you requested.
• Right to Restriction of Processing. If you believe we process data incorrectly – whether for reasons of processing or its scope, please let us know.
• Right to Notification of Correction, Erasure, or Restriction. If you contact us with a request, we will inform you of the outcome unless it is impossible (e.g., the email address from which you wrote to us is no longer functional).
• Right to Data Portability. We can provide your data, which you have given us, in a structured, machine-readable format to another Administrator at your request.
• Right to Object. If we process your data based on legitimate interest (e.g., sending newsletters). It is up to us to prove our legitimate interest, if you agree, we will stop this processing.
• Right to Withdraw Consent. If you’ve changed your mind, please write to us. You can withdraw processing related to marketing and business purposes at any time.
• Automated Individual Decision-Making, Including Profiling. You have the right not to be subject to any decision based solely on automated processing, including profiling, that would have legal effects concerning you or similarly significantly affect you. We respect your rights, and therefore, do not conduct profiling.
